Open Question: First time home buyer credit is being denied?

My fiance did her taxes with a woman who fudged some numbers on her 2009 return, and even put down that she paid mortgage payments in the past. My fiance knows nothing about doing taxes. The return was pretty good, but obviously it came with a catch. So after she bought her first house in Feb 2010, she was denied the $8,000 tax credit.

Since receiving the first denial letter stating she paid mortgage payments on a prior house, we sent in a 1040x form, to correct our taxes. In turn, they sent her a bill for $400 for the overpayment on her 2009 return, and ANOTHER denial letter. (How can they address the mistake, and STILL deny her?) Anyway, recently she sent in a letter stating the lady that did her taxes (runs a business out of a pawn shop) did them in error, and she would like to appeal the decision.

What can we expect, will she ever see her tax credit? Will we run out of time to file? We are becoming disheartened because we are suffering from this woman’s mistakes on her taxes!!!!
Okay guys after reading the first two responses, let me clarify. Again, first — my fiance knows nothing about taxes. Second, the tax preparer did this on her OWN merit. We had no idea, we were just surprised when the return was more than expected. Yes, it was our fault that we didn’t immediately ask her why it was high, so yea she messed up there. ANYWAY, the tax preparer even told us that SHE messed up, and willingly prepared our 1040x for us. This was her first year ever going to this woman — and the last.
Oh and my fiance never “reviewed” the taxes, just filled out the application, and the preparer took it from there. She just awaiting the direct deposit. She NEVER informed her of a previous house, and even told her before preparing her 2009 return that she was filing for the 8000 tax credit. Why the preparer willingly put down mortgage payments on the return is beyond us. And for that, we are getting the short stick. This is so frustratingly daunting.
